It's kinda confusing because he's said to be 16 by some people but I think of him as about 19

If I had to guess, I'd say between 16 and 18.

He has to be at most 17, as he was recently emancipated from Bruce and you have to have status as a minor for that.
 
My gut says 17.

as of Red Robin #17 it seems that Tim is 17 because in that issue he meets with his friend Ives who is the same age as him, and is in his last year of high school, so he's not 18 yet.  
also, as of RR #17 he is going to be living in the theatre in crime alley, where Batman was born.
