Given the conditions...i hate to say it...I think LL takes this. The guy has some near godlike feats when he's able to prep. Obviously Doom is a god of prep too...but Lex has put himself on par with near eternal intelligences.
I'd probably say Punisher's is more stupid, being a happy idealist myself, I find Frank's lack of control, his cynicism, and general malice unpalatable. When in human history has killing people ever resulted in lasting peace and happiness? I'm sure people will respond "when did imprisonment ever have those results?" And maybe they're right. Maybe there is no difference...except in one of those scenarios you yourself are a killer. Punisher is still fighting bad guys in a grimy corrupt horrible world himself, despite all the killing he's done for the sake of punishment and protection of the innocent. At the end of the day, all the killing he's done hasn't really made the world better for anyone but the one person seeking self gratification in the act.
Marvel's had movies big as and bigger than the Nolan films. What they lacked however was having that unique and memorable power that extends outside of typically comic fare.
That said, I think X-Men days of future past came close, and Cap 2 did a good job of being a bit more than a comic movie. Loved both of them too.
But yah, the Nolan films are incredibly hard to outdo. He chose the right character to try that with, and pulled it off brilliantly.
Any list that doesn't have these 3 in the top 10 is just wrong. These characters have each had vital turns in comics in the mainstream culture, and that's doing a favor to everyone here. Give them their due respect.
1) Batman
2) Superman
3) Spiderman
After that, it's maybe a bit more a matter of preference. Mine is:
Guess I'll go with Thor. Granted, his dialogue has been abysmal since the dawn of time, and the writing hasn't been impressive in general, but the abilities of the character and the surroundings he's been adapted to is pretty impressive.
3rd, I'll say Daredevil. Crime fighter, minimally powered, and interesting premise.
