Spider-Man 2099 may use feats from the original (Volume 1) as well as the new (Volume 2 and 3) timelines.
Assassin Spider-Man may use feats for 616 Spider-Man up to and including the Spider-Man vs. Wolverine issue (from February 1987) where their timelines diverge. After, he may only use feats he has performed himself.

(after wolverine vs spider-man) i think he should have access to those feats since he is the same spidey , who just took a different route.Logically if anything he should be stronger due to training.

Well, Spider-Man has had strength boosts since then (ex. in Avengers Disassembled, or from The Other) which is why I thought it might not be fair, especially considering that Miguel already has a lot fewer issues to draw feats from. Even generally, Spider-Man has got a lot better strength feats starting from the late 90s, which we don't really know if Assassin Spidey can replicate.

Miguel O'Hara was a young super-genius working at Alchemax, one of the largest corporations in a world where capitalism spiraled out of control, leaving a select few members of the elite with all the power. One day, one of his experiments - to replicate the powers of the present day Spider-Man - was sabotaged, overwriting his DNA to make it 50% spider! This granted him amazing powers, similar to those of Peter Parker, with a few key differences. Instead of Spider Sense, he possesses an Accelerated Vision which grants him near-perfect visual acuity, so he can see objects at much greater distances and in near total darkness. Furthermore, it enables him to see objects move much more clearly and slowly, to the point that it can act as a biological warning system, though not to the same effect as Spider Sense. In addition, he can produce organic webbing, as well as a non-lethal paralysis agent he can secrete through fangs he has in his mouth.
Miguel eventually gets transported to the present, meeting and allying with the Spider-Man of today - Peter Parker. This comes with some extra benefits for him, such as a job as Parker Industries' Head of Research and Development as well as a much more upgraded Parkertech suit, granting him significantly increased durability, access to various weaponry, flight, as well as holographic projection and stealth capabilities. The suit also interfaces with Miguel's holographic assistant from 2099, Lyla, who can provide him with useful information from various sources (including the internet as well as data from 2099) and control the suit's various capabilities (similar to JARVIS or FRIDAY in Iron Man armour).
Power Level
Strength:
1- Miguel easily lifts up a car
2- Miguel breaks off and lifts a tank turret
3 - Miguel matches Thor 2099's strength
4 - tears off Venom 2099's hand (same symbiote as present day Venom) with ease
Speed:
1 - easily dodges point blank gunfire while also shooting webs
2 - quick enough to dodge targeted missiles and redirect them with webbing
3 - easily dodges machine gun fire
4 - can tag Peter Parker Spider-Man despite Spider Sense (although that is Otto Octavius controlling the body)
Durability:
1 & 2 - survives Thor 2099 throwing Mjolnir at him hard enough to drop a building on him without being unconscious
3 - survives Lash's disintegration blast
4 - survives a shot from a plasma cannon meant to hurt Hulk
Intelligence:
1 - easily overrides Alchemax computers
2, 3, & 4 - fixes Dr. Doom's time machine with parts from old Iron Man armours (which Maestro was unable to do)
5 - easily hacks Dr. Doom, Reed Richards, and Tony Stark
Other:
1 - his venom is strong enough to temporarily paralyze the Sub-Mariner, an Atlantean
2 - his accelerated vision enables him to see wavelengths outside just visible light
3 - his accelerated vision enables him to see in near complete darkness
4 - he projects organic webbing through spinnerets in his forearms
5 - he can control the thickness and strength of his webbing
Additional abilities given to him by Lyla and the suit:
1 - quick overview of the Parkertech suit's capabilities
2 - the suit has flight and GPS systems
3 - the suit has thermal scanners
4 - the suit can automatically aggregate information from the Internet
5 - the suit has camouflage/invisibility
6 - the suit can create holographic illusions as decoys
7 - Lyla can also project holograms to change Miguel's appearance
8 - Lyla can track people after Miguel tags them with his form of spider-tracers
9 - the suit can monitor vitals
10 - Lyla can wirelessly tap into other people's brains and stimulate them
Explosive Spider-Saucers:
1 - the spider-saucers can be launched remotely and are powerful enough to hurt Dr. Cronos' (the foremost robotics expert in the world and Dr. Doom's teacher) robot/cyborg body
2 - they can blow a huge hole in the rock/ground
3 - powerful enough to completely destroy Iron Man 2099's armour
Conclusion
Despite Assassin Spider-Man's obvious advantage in the fact that he has a spider sense (not to mention an extremely upgraded one), Miguel comes out top here due to his far superior durability and impressive versatility, which come about from his more varied powers, access to Lyla as his personal assistant, and the gadgets and gizmos packed into his Parkertech armour. In this battle at least, a more versatile and all-around greater powerset trump martial expertise.

lol I agree. I'm currently finishing up a Black Panther vs Spider-Man CaV but if you know anyone who is willing to go up against Miguel please let me know since I'd love to do another battle with him, if this one ends up getting forfeited by @logicuser.
