Not putting Joker down like a rabid dog. Something that Rorschach would do in a heartbeat, because he realized the difference between common crooks and monsters.

I definitely agree with this, and this is why I don't respect Batman as a hero. Whereas most heroes face their monsters, and defeat them in a final battle, Batman keeps his around to justify his own existence.

No, Batman isn't a telepath or omniscient. He is a great detective but If he has no clues and he has a very limited time to find Ra´s, the best thing he can do is revive the Joker.

Seriously speaking though, do we get a lot of Scarecrow/Batman comics? I mean, given their intent is to use fear against civilians/criminals, you'd think he would possibly have been the better choice to challenge Batman. Plus, there have been some brilliant (scientifically speaking,) versions of Scarecrow, meaning he could match Bruce on an intellectual level more often than not.

@battle_forum_junkie: he's been on hiatus for two years now. I kind of like it that way. Before he could show up at anytime, no different than any other bat villain. Now, his appearances are rare and special and I think that makes his character that much more powerful and great.

@anjales: Norman Osborn and Lex Luthor have both shown they can do good. If you don't see the million reasons Captain AMERICA executing anyone would send a bad message you must be dense. Batman/Joker is a completely different case. Superman, Spider-Man, and Cap all have images to uphold. Batman's image is DEPENDENT on him being frightening.
