After being sent to jail in issue #2, the Vulture being a model prisoner has earned the right to use the machine shop in the prison where he has secretly been constructing a makeshift flying harness in order to escape his imprisonment. Upon its completion, he then proceeds to simply fly over the prison wall while out in the exercise yard and make his escape. Peter Parker upon hearing of the escape quickly heads home to change into Spider-Man and apprehend the Vulture once more.
Bringing his anti-magnetic inverter which he used against the Vulture in their first encounter he does not realize that the Vulture has modified his wings to not only fly and maneuver better but it is now not affected by the inverter Spider-Man used to defeat him with in the initial encounter. Whilst robbing a jewellery store the Vulture is spotted by Spider-Man and as the two begin to battle he fakes falling due to Spider-Man's inverter in order to gain the upper hand. Spider-Man crash lands on a nearby rooftop and the Vulture believing that he has in fact defeated Spider-Man flies off to plot his next heist. Spider-Man meanwhile has in fact survived the fall but has sustained a severely sprained arm in the process.
Whilst Peter attempts to sell his pictures of the Vulture to J. Jonah Jameson the Vulture happens to arrive to rob the Bugle of its payroll. As Jameson tries to talk the Vulture out of stealing from him, Peter manages to sneak out of the room and change into Spider-Man and returns as the two are still arguing. Spider-Man and the Vulture begin fighting in the office and all throughout the building causing great amounts of damage and chaos as they go. Eventually finding themselves outside the Vulture carries Spider-Man high into the air at which point Spider-Man webs the Vulture's wings together so he is unable to continue to fly. As the two plummet to the ground Spider-Man makes a web parachute which allows the two to glide to safety and the police waiting below capture the Vulture once again. Spider-Man passing by the Bugle discovers that Jameson is holding him responsible for the mess and damage in the office. Annoyed, Spider-Man webs Jameson's mouth shut and returns inside to change back into Peter Parker. Peter and Betty are then allowed to enjoy a peaceful afternoon together as Jameson huffs around the office in silence, awaiting the webbing to dissolve.
