I agree with him on how the legality of this should work. Of course it's hard to make laws like "you know it when you see it", but I agree that there's some situations where I wouldnt want that person being arrested, and some where I would. "Dont be stupid" sounds like a good general philosophy.
Well, the situation is totally different. The Law System in Italy is quite different from the American one, so there are some point that must be outlined:
1) The "Higher Court" of this case is the "Corte di Cassazione". Even if it is technically the "Third Grade of Judgment", the "Corte di Cassazione" judge only on the procedural and correct application of the law in the first two grade of Judgment. So if the "Corte di Cassazione" change the result of the First and Second Grade of Judgment it is not give an "opinion" on the matter, only on the technical part of the Judgment
2) The "Legal Precedent" in Italy dosen't costituite law for other judgment, so the "higher court" statement [as that of any other level of judgment] is valid only for that given case. However, Judge are called to consider and valure previows similar case, but it is in no way bound to follow the same decision
3) In this case, the "Corte di Cassazione" state that there is no penal legal proceedings for a crime that have no "imprisoning consequence", but the man is still under judgment for the infraction and he can be charged with a penality from 5.000,00 to 30.000,00 euro to pay to the State, and also he may be judged for civil legal proceedings, and been condamned to refound some of the victims.

That could be a little troublesome if you ask me...
So if a 17 year old passes by (still a minor if i'm understanding correctly) and the guy is there fapping, the he could go to jail. But the problem is, sometimes 17-16 years old look a little grown up, so it's pretty hard to determine if they are minors or not.
Or what if you are in the middle of the jacking and a bunch of minors suddenly appear
Maybe the news fed gave a really vague approaching of the law, because as i read it, it looks pretty stupid and inapplicable
